This Affiliate Program Agreement ("Agreement") is made and entered into by and between DutchTexan, LLC ("Company"), and the individual or entity registering as an affiliate ("Affiliate").

1. Enrollment in the Program

To enroll in the Affiliate Program, the Affiliate must complete the registration process and be approved by the Company. The Company reserves the right to accept or reject any application at its sole discretion.

2. Commission Structure

- The Affiliate will earn a 20% commission on the GoDutchTexan plans.

- The Affiliate will earn a 10% commission on the uPanthera plans.

- Commissions are calculated based on the actual amount paid by the referred customer, excluding taxes, refunds, and chargebacks.

3. Payment Terms

- Commissions will be paid via PayPal on the 20th of the following month for the previous month’s earnings.

- The Affiliate is responsible for providing accurate PayPal account details. The Company is not liable for payments sent to incorrect accounts due to inaccurate details provided by the Affiliate.

- The Company reserves the right to withhold payments if fraudulent activity, chargebacks, or refund requests are suspected.

4. Affiliate Responsibilities

- The Affiliate must market and promote Company products and services in an ethical manner.

- The Affiliate may not misrepresent the Company, its products, or make false claims.

- The Affiliate may not engage in spam, misleading advertisements, or unauthorized paid advertising using the Company’s brand name.

5. Termination

- Either party may terminate this Agreement at any time, with or without cause, by providing written notice.

- If terminated, any unpaid commissions will be forfeited if the termination is due to a breach of this Agreement.

6. Independent Contractor Relationship

The Affiliate is an independent contractor and not an employee, partner, or agent of the Company. The Affiliate has no authority to bind the Company in any manner.

7. Modifications

The Company reserves the right to modify this Agreement at any time. Affiliates will be notified of any changes, and continued participation in the program constitutes acceptance of the updated terms.

8. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

By registering as an Affiliate, you acknowledge that you have read, understood, and agreed to the terms of this Agreement.
